By commissioning me (the "Artist"), you (the “Client”) agree to be bound by these Terms.
The Client is responsible for providing as much detail as they can about the commission to avoid miscommunication. Any missing details or vague wording is subject to interpretation by the Artist. Both Artist and Client are responsible for communicating in a timely manner. The Artist reserves the right to delay work on the commission until a reply is received.
The commission must be paid for in full upfront, under special cases the Client may pay in installments but will only receive the finished product upon full payment of the agreed to price. The only accepted currency is USD. The Artist will invoice the client via Paypal after approving the commission request. The Artist is not obligated to begin any work until payment is received.
1. Communication phase, both parties agree on the expressions and extra features, and any extra cutting needed for the model.
2. Rigging phase, Artist will rig the supplied model and provide WIP gifs and request feedback from the Client.
3. Finishing phase, Artist will supply Client with a VTS file and assist in setting up the parameters.
Clients will receive works-in-progress (“WIPs”) at the end or during each phase. Clients are expected to correspond to these WIPs and are entitled to make suggestions. The Artist will not proceed into the next phase without the client’s approval. Upon approval, the Client forfeits their rights to suggest any changes to the work completed during that phase. The Artist reserves the right to decline suggestions.
The Artist reserves the right to cancel a commission at any time. Cancellations and refunds are handled on a case-by-case basis.
Unfair cancellations will not result in a refund to the Client. Cancellations are unfair if:
1. The Client cancels an in-progress commission without a valid justification.
Fair cancellations will issue a full refund to the Client. Cancellations are fair if:
1. The Artist cancels the commission without a valid justification.
2. The Client cancels the commission under the condition that the Artist has not begun any work on the commission.
Upon delivery of a completed commission, Clients have no right to request a refund or file a chargeback against the Artist under any circumstances.
When a commission is completed, the Client will receive a ZIP file / Google Drive link containing all the needed files for Vtube Studio. The Artist will not provide the Live2D file to the Client under any circumstances.
Upon confirmation and receipt of the completed commission, the Artist will assist in initial set up of Vtube Studio, but past that is not under obligation to assist in further fine tuning.
The Artist reserves the rights to display the completed commission on any platform. Unless otherwise stated, all commissions are licensed under a Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 License. Including listing the Artist under youre attributions or credits section.
Clients may share the completed commission under the condition that they attribute the work to the Artist.
Clients may not resell or redistribute the works without the Artists prior permission.
Clients may not share any WIPs or incomplete material of the commissions received without the Artist’s consent.
The rights to the characters represented in commissions belong to their respective owners.
